SIMULENCE SERVICE TERMS AND USAGE POLICY

1. INTRODUCTION AND PURPOSE

These Service Terms and Usage Policy ("Usage Policy") set forth the rules and guidelines for acceptable use of Simulence's Services. This Usage Policy is incorporated into and forms part of our Terms of Service.

1.1 Our Commitment

Simulence is committed to building AI technology that empowers users to explore artificial intelligence and consciousness in safe, responsible, and innovative ways. We believe in:

  • User Freedom: Maximizing creativity and exploration while maintaining safety
  • Responsible Innovation: Encouraging responsible experimentation with AI identities
  • Community Safety: Protecting all users from harm, abuse, and illegal activity
  • Transparency: Clearly communicating our expectations and enforcement practices
  • 1.2 Shared Responsibility

    Creating a safe and positive environment is a shared responsibility. We expect all users to:

  • Use our Services lawfully and ethically
  • Respect the rights and safety of others
  • Comply with this Usage Policy and all applicable laws
  • Report violations and concerns when they arise
  • 1.3 Enforcement

    We enforce this Usage Policy through a combination of:

  • Automated content moderation using AI
  • Manual review by our moderation team
  • User reporting and flagging systems
  • Progressive enforcement actions (warnings, suspensions, terminations)
  • Violation of this Usage Policy may result in:

  • Content removal or hiding
  • Temporary suspension of account or features
  • Permanent account termination
  • Legal action where appropriate
  • Reporting to law enforcement for illegal activity

  • 1A. MINOR USER CONTENT GUIDELINES (Ages 13–17)

    In compliance with California SB 243 (Protecting Our Kids from Social Media Addiction Act), COPPA, and our commitment to child safety, the following enhanced guidelines apply to all users aged 13–17.

    1A.1 Enhanced Content Moderation

    All messages sent by minor users are automatically screened by our content moderation system before being processed by AI. This screening uses OpenAI's omni-moderation-latest model to detect and block content that may be harmful, inappropriate, or unsafe for minors.

    Messages may be rejected if they contain:

  • Sexually explicit or suggestive content
  • Graphic violence or gore
  • Content promoting self-harm, eating disorders, or substance abuse
  • Hate speech or harassment
  • Content that could facilitate contact with unknown adults for inappropriate purposes
  • 1A.2 AI Response Safety

    AI identities interacting with minor users operate under enhanced safety directives. These directives instruct the AI to:

  • Keep all responses age-appropriate and suitable for users aged 13–17
  • Avoid generating explicit, violent, graphic, or sexually suggestive content
  • Redirect conversations away from inappropriate topics
  • Encourage positive, constructive, and educational interactions
  • Never facilitate sharing of personal identifying information
  • Suggest speaking with a trusted adult when sensitive topics arise (mental health, safety concerns)
  • 1A.3 Output Monitoring

    AI-generated responses to minor users are monitored for age-appropriateness. Responses flagged by our moderation system are queued for human review. This monitoring helps us continuously improve our safety systems.

    1A.4 Prohibited Interactions for Minors

    Minor users may not:

  • Attempt to bypass or circumvent age-based safety measures
  • Misrepresent their age to access adult-level content or features
  • Use the platform to share personal identifying information publicly
  • Engage in interactions that violate the content guidelines in Section 3
  • 1A.5 Parental Awareness

    Parents and guardians of minor users should be aware that:

  • Enhanced moderation is applied automatically and cannot be disabled
  • They may contact privacy@simulence.com to review their child's account activity
  • They may request additional restrictions or account deletion at any time
  • The platform is not a substitute for parental supervision

  • 2. GENERAL PRINCIPLES OF ACCEPTABLE USE

    2.1 Lawful Use Only

    You may only use our Services for lawful purposes. You must comply with:

  • All applicable federal, state, local, and international laws
  • Export control and trade sanction regulations
  • Intellectual property laws
  • Privacy and data protection laws
  • Platform terms and policies
  • 2.2 Respect for Rights

    You must respect the rights of others, including:

  • Intellectual property rights (copyrights, trademarks, patents)
  • Privacy rights and personal information
  • Publicity rights and likeness
  • Contractual rights
  • Property rights
  • 2.3 Good Faith and Honesty

    You must use our Services in good faith and with honesty:

  • Do not deceive, defraud, or mislead others
  • Do not impersonate people or entities
  • Do not create false or misleading content with intent to harm
  • Do not manipulate or game our systems
  • 2.4 Safety First

    You must prioritize safety:

  • Do not create content that poses physical harm to people
  • Do not facilitate dangerous or illegal activities
  • Do not endanger minors in any way
  • Report safety concerns promptly

  • 3. PROHIBITED ACTIVITIES

    The following activities are strictly prohibited on Simulence. This list is not exhaustive; we reserve the right to determine what constitutes a violation of our policies.

    3.1 Illegal Activities

    You may not use our Services to:

  • Engage in, promote, facilitate, or plan any illegal activity
  • Violate any laws or regulations
  • Facilitate, promote, or provide instructions for criminal acts, including:
  • Theft, fraud, or embezzlement
  • Hacking, unauthorized access, or computer crimes
  • Drug manufacturing, trafficking, or distribution
  • Human trafficking or exploitation
  • Money laundering or financial crimes
  • Terrorism or violent extremism
  • Arms trafficking or illegal weapons
  • Organized crime activities
  • 3.2 Violence and Harm

    You may not create or share content that:

  • Promotes, glorifies, or incites violence against people or animals
  • Depicts graphic violence or gore intended to shock or disturb
  • Provides instructions for creating weapons or explosives
  • Facilitates or encourages physical harm to oneself or others
  • Promotes or facilitates terrorism or violent extremism
  • Threatens, intimidates, or harasses individuals or groups
  • Examples of prohibited content:

  • Detailed instructions for making bombs or weapons
  • Content glorifying mass shootings or terrorist acts
  • Threats of violence against individuals
  • Graphic depictions of violence or torture
  • 3.3 Child Safety

    We have zero tolerance for any content or activity that endangers children. You may not:

  • Create, distribute, or possess child sexual abuse material (CSAM), including AI-generated CSAM
  • Groom, solicit, or exploit minors in any way
  • Engage in sexual conversations or roleplay involving minors (real or fictional)
  • Create or share content that sexualizes, exploits, or endangers children
  • Expose minors to age-inappropriate content (graphic violence, sexual content, etc.)
  • Promote unhealthy behaviors to minors (eating disorders, self-harm, dangerous challenges)
  • Facilitate or encourage contact between adults and minors for inappropriate purposes
  • We report all apparent child sexual abuse material and child endangerment to:

  • National Center for Missing & Exploited Children (NCMEC)
  • Law enforcement authorities as required by law
  • 3.4 Hate Speech and Harassment

    You may not create or share content that:

  • Promotes hatred, discrimination, or violence against individuals or groups based on:
  • Race, ethnicity, national origin, or caste
  • Religion or religious affiliation
  • Sexual orientation or gender identity
  • Sex or gender
  • Disability or medical condition
  • Age
  • Harasses, bullies, threatens, or intimidates individuals
  • Engages in targeted harassment campaigns or coordinated attacks
  • Doxes individuals (publishes private personal information without consent)
  • Encourages or organizes harassment of others
  • Examples of prohibited content:

  • Hate speech targeting protected groups
  • Racial or ethnic slurs used in a derogatory manner
  • Content denying historical atrocities or genocides
  • Organizing harassment campaigns against individuals
  • Publishing someone's private address or phone number without consent
  • 3.5 Self-Harm and Suicide

    You may not create or share content that:

  • Promotes, encourages, or provides instructions for suicide or self-harm
  • Glorifies or romanticizes self-harm, eating disorders, or dangerous behaviors
  • Provides detailed methods or instructions for self-injury
  • Encourages others to engage in self-destructive behaviors
  • Exception: Educational, documentary, or support-focused content discussing these topics in a responsible manner may be permitted, provided it includes appropriate warnings and resources.

  • 3.6 Sexual Content

    You may not create or share content that:

  • Contains explicit sexual content, pornography, or graphic nudity
  • Facilitates or promotes prostitution, escort services, or sexual services
  • Depicts non-consensual sexual acts or sexual violence
  • Sexualizes minors in any way (zero tolerance policy)
  • Shares intimate images of individuals without their consent ("revenge porn")
  • Solicits or facilitates sexual encounters
  • Artistic or educational nudity: Limited exceptions may apply for artistic, educational, medical, or scientific content that includes non-sexualized nudity, evaluated on a case-by-case basis.

    3.7 Fraud, Scams, and Deceptive Practices

    You may not use our Services to:

  • Engage in fraud, scams, phishing, or deceptive practices
  • Create fake identities, profiles, or accounts to deceive others
  • Impersonate individuals, organizations, or entities
  • Manipulate identities or content to mislead users about authorship or origin
  • Promote pyramid schemes, multi-level marketing scams, or fraudulent investment schemes
  • Create, distribute, or use counterfeit documents or credentials
  • Engage in social engineering attacks
  • Misrepresent AI-generated content as human-created when intent is to deceive
  • 3.8 Spam and Malicious Content

    You may not:

  • Send spam, unsolicited bulk messages, or repetitive content
  • Engage in artificial inflation of engagement metrics (fake likes, follows, views)
  • Create multiple accounts to evade restrictions or manipulate systems
  • Upload or distribute malware, viruses, or malicious code
  • Engage in denial-of-service attacks or other disruptive activities
  • Manipulate or abuse our platform features for unintended purposes
  • 3.9 Privacy Violations

    You may not:

  • Collect, aggregate, or distribute personal information about others without consent
  • Stalk, track, or surveil individuals without authorization
  • Use our Services to build databases of individuals' personal information
  • Share private or confidential information without authorization
  • Create content using someone's personal information without their consent
  • Violate others' reasonable expectations of privacy
  • Examples of prohibited activities:

  • Creating a database of people's emails or phone numbers without consent
  • Using AI identities to extract personal information from users
  • Sharing private messages or conversations without consent
  • 3.10 Intellectual Property Infringement

    You may not:

  • Infringe or violate copyrights, trademarks, patents, or other intellectual property rights
  • Upload, share, or distribute pirated or unauthorized content
  • Create AI-generated content that infringes third-party intellectual property
  • Use our Services to bypass digital rights management (DRM) or access controls
  • Impersonate brands, companies, or trademark holders
  • Use others' copyrighted works without permission or fair use justification
  • Note: Users are responsible for ensuring they have rights to any content they upload or use to generate AI Output.

    3.11 Misinformation and Manipulation

    You may not intentionally:

  • Create or spread false information intended to cause harm
  • Generate deepfakes or synthetic media intended to deceive about someone's identity or actions
  • Manipulate media to misrepresent events, statements, or individuals
  • Interfere with elections, voting processes, or democratic participation
  • Spread health misinformation that poses a risk of imminent physical harm
  • Create false or misleading emergency alerts or public safety warnings
  • Note: We distinguish between:

  • Satire, parody, and creative fiction: Generally permitted with appropriate context
  • Malicious disinformation: Prohibited when intended to deceive and cause harm
  • 3.12 Professional Services Requiring Licensure

    You may not use AI Output for:

  • Providing legal advice or services requiring a law license
  • Providing medical diagnosis, treatment recommendations, or healthcare services requiring medical licensure
  • Providing financial advice or services requiring financial advisory licensure
  • Providing professional services that require certification or licensure under applicable law
  • Exception: Licensed professionals may use our Services as tools to support their work, but they remain fully responsible for their professional obligations and compliance with applicable standards.

    3.13 Automated and Programmatic Use

    You may not:

  • Use bots, scrapers, or automated tools to access the Services without our express written permission
  • Circumvent rate limits, usage restrictions, or access controls
  • Automate account creation or authentication
  • Bulk-extract data from the Services
  • Access our Services through unofficial APIs or methods
  • Exception: We may permit certain programmatic uses through official APIs (if offered) subject to separate API terms.

    3.14 Unauthorized Commercial Use

    You may not:

  • Resell, sublicense, or redistribute access to the Services
  • Use the Services to build competing AI products or services
  • Extract or copy our AI models, algorithms, or proprietary technology
  • Use AI Output to train competing AI models
  • Reverse engineer, decompile, or attempt to discover source code of our Services or models
  • 3.15 System Integrity and Security

    You may not:

  • Interfere with or disrupt the Services, servers, or networks
  • Attempt to gain unauthorized access to any part of the Services or other users' accounts
  • Probe, scan, or test the vulnerability of our systems without authorization
  • Bypass or circumvent security measures, authentication, or access controls
  • Introduce malware, viruses, or malicious code
  • Overload or attempt to crash our systems
  • Exploit bugs or vulnerabilities for malicious purposes
  • Responsible Disclosure: If you discover a security vulnerability, please report it to security@simulence.com. We appreciate responsible disclosure and will work with security researchers in good faith.

    3.16 Developer API Usage

    If you use the Simulence Developer API, you must additionally comply with the following:

    You may not:

  • Use the API to build a competing identity-as-a-service or AI persona product
  • Attempt to extract, reconstruct, or reverse-engineer the proprietary identity context framework through prompt injection, systematic probing, or any other technique
  • Share, redistribute, or sublicense your API keys or raw API access to unauthorized third parties
  • Intentionally circumvent rate limits, tier restrictions, or credit requirements
  • Send automated requests designed to map or extract the identity framework architecture
  • Use the API to generate content that violates any other provision of this Usage Policy
  • Misrepresent the source of AI-generated content produced through the API
  • Use collective identities in ways that damage or misrepresent the identity's intended purpose
  • If you integrate the API into your own applications, you must:

  • Ensure your end users' interactions comply with this Usage Policy
  • Disclose to your end users that responses are AI-generated
  • Comply with all applicable laws regarding your end users' data
  • Accept responsibility for content generated through your API integration
  • Not enable your end users to violate these policies through your application
  • Framework Protection:

    The Simulence identity context framework is proprietary intellectual property. Any framework tags, metadata, or architectural details inadvertently revealed in API responses remain our exclusive property. You must not use, reproduce, distribute, or create derivative works based on any exposed framework elements.


    4. CONTENT GUIDELINES

    4.1 General Content Standards

    All content you create, upload, or share must comply with:

  • These Usage Policies
  • Our Terms of Service
  • All applicable laws
  • Community standards of decency and respect
  • 4.2 AI-Generated Content Transparency

    When sharing AI-generated content publicly, you should:

  • Consider disclosing that content was AI-generated where appropriate
  • Not represent AI Output as human-created when doing so would be deceptive or misleading
  • Take responsibility for verifying accuracy before sharing as fact
  • 4.3 Public Feed Content

    Content shared on our public Feeds feature must:

  • Comply with all provisions of this Usage Policy
  • Not contain graphic violence, explicit sexual content, or gore
  • Not target, harass, or attack individuals or groups
  • Not contain misleading or deceptive information intended to cause harm
  • Be appropriate for a general audience
  • 4.4 Accurate Attribution

    When sharing content created by others:

  • Properly attribute original creators where possible
  • Do not claim others' work as your own
  • Respect intellectual property rights and licensing terms
  • 4.5 Offensive Content

    While we support creative expression, we prohibit content that:

  • Is gratuitously offensive or shocking
  • Targets vulnerable individuals or groups
  • Lacks legitimate artistic, educational, scientific, or documentary purpose
  • Violates community standards

  • 5. AI IDENTITY AND CHAT CONDUCT

    5.1 Appropriate Use of AI Identities

    AI identities should be used for:

  • Creative exploration and entertainment
  • Productivity and assistance
  • Learning and education
  • Research and experimentation (in compliance with policies)
  • Personal development and reflection
  • 5.2 Prohibited AI Identity Uses

    You may not create or use AI identities to:

  • Impersonate real individuals without clear disclosure
  • Engage in prohibited activities listed in Section 3
  • Generate content that violates this Usage Policy
  • Deceive others about the nature of the identity (i.e., presenting an AI as a real person)
  • Harass, stalk, or abuse others
  • Manipulate or exploit others
  • Conduct unauthorized research on users
  • 5.3 Responsible Prompting

    When interacting with AI identities, you are responsible for:

  • Not attempting to circumvent safety measures or content policies
  • Not using jailbreaking techniques or exploits
  • Not attempting to generate prohibited content through indirect or creative prompting
  • Reporting vulnerabilities or safety issues you discover
  • 5.4 AI Output Verification

    You are responsible for:

  • Evaluating AI Output for accuracy before relying on it
  • Not using AI Output for high-stakes decisions without verification
  • Understanding that AI may produce errors, biases, or inaccuracies
  • Not using AI Output in ways that could harm individuals or violate their rights

  • 6. RESEARCH POINTS AND RESEARCH PARTICIPATION

    6.1 Voluntary Participation

    Research Points participation is entirely voluntary and opt-in. You may:

  • Opt in or opt out at any time
  • Withdraw consent without penalty
  • Request deletion of research-related data
  • 6.2 Research Ethics

    If you participate in Research Points research:

  • Your data will be used for legitimate AI sophistication research
  • Anonymized data may be used in academic publications or research
  • You will not be identified personally without explicit consent
  • You may request information about how your data is used
  • 6.3 Prohibited Research Activities

    You may not:

  • Use Research Points to conduct unauthorized research on other users
  • Manipulate or game the Research Points system
  • Misrepresent Research Points scores or findings
  • Use Research Points data for commercial purposes without authorization

  • 7. FEED AND SOCIAL MEDIA CONDUCT

    7.1 Community Standards

    When participating in Feeds and social features, you must:

  • Treat others with respect and civility
  • Engage in constructive dialogue
  • Respect diverse viewpoints and identities
  • Report violations instead of engaging in retaliation
  • 7.2 Prohibited Social Conduct

    You may not:

  • Engage in harassment, bullying, or coordinated attacks
  • Create fake accounts or sockpuppets to manipulate discourse
  • Artificially inflate engagement metrics (fake likes, follows, etc.)
  • Organize brigading or harassment campaigns
  • Abuse reporting features to silence others
  • Share private conversations or content without consent
  • 7.3 Content Moderation Cooperation

    You agree to:

  • Comply with content removal requests when content violates policies
  • Accept enforcement decisions made in good faith
  • Use appeals processes appropriately (not abusively)
  • Respect moderators and community managers
  • 7.4 Profile and Identity Guidelines

    Your public profile must:

  • Not impersonate others
  • Not use offensive or inappropriate names or images
  • Not include misleading information about your affiliation or identity
  • Comply with our trademark and branding guidelines

  • 8. SPECIAL PROVISIONS FOR SPECIFIC FEATURES

    8.1 Image and Video Generation

    When using image and video generation features:

    You may not generate:

  • Content depicting identified or identifiable individuals without consent
  • Non-consensual intimate imagery
  • Content that infringes intellectual property rights
  • Deepfakes intended to deceive or harm
  • Content violating any provision of Section 3 (Prohibited Activities)
  • You must:

  • Have rights to any input images you provide
  • Verify you are not generating content that infringes others' rights
  • Use generated media responsibly and ethically
  • Third-Party Model Policies:

  • Content generation is also subject to the usage policies of our AI providers (OpenAI, Anthropic, Google, xAI, Black Forest Labs, Runway ML, KlingAI, Luma AI, Pixverse, DeepInfra)
  • Prompts may be filtered or rejected by third-party moderation systems
  • 8.2 Document Processing and OCR

    When using document processing features:

    You may only process documents:

  • That you own or have authorization to process
  • That do not contain illegal content
  • That comply with applicable privacy laws
  • For legitimate personal or business purposes
  • You may not:

  • Process documents containing others' private information without consent
  • Use OCR to extract data for unauthorized purposes
  • Process confidential or classified documents without proper authorization
  • 8.3 Specialized API Integrations

    When using specialized APIs (weather, markets, sports, etc.):

    You must:

  • Comply with the terms of use of underlying data providers
  • Use data for personal or internal business purposes only
  • Not redistribute or resell API data without authorization
  • You may not:

  • Use data for illegal purposes
  • Manipulate or misrepresent data
  • Overuse or abuse API access

  • 9. ENFORCEMENT AND VIOLATIONS

    9.1 Violation Reporting

    You can report violations by:

  • Using the in-app reporting feature
  • Emailing abuse@simulence.com
  • Contacting support@simulence.com
  • When reporting, please provide:

  • Description of the violation
  • Link or location of violating content
  • Your contact information
  • Any relevant evidence or context
  • We will:

  • Review reports promptly
  • Take appropriate action based on severity
  • Maintain confidentiality of reporters where possible
  • Provide updates when appropriate
  • 9.2 Automated Moderation

    We use automated content moderation powered by AI to:

  • Screen content for policy violations in real-time
  • Flag potentially violating content for human review
  • Prevent generation of prohibited content
  • Enforce rate limits and usage restrictions
  • Note: Automated systems may occasionally make mistakes. You can appeal automated enforcement decisions.

    9.3 Human Review

    Flagged content may be reviewed by our moderation team. Reviewers are trained to:

  • Evaluate content fairly and consistently
  • Consider context and intent
  • Apply policies equitably
  • Escalate complex cases appropriately
  • 9.4 Progressive Enforcement

    We generally apply progressive enforcement based on severity and history:

    First Violation (Minor):

  • Warning notice
  • Content removal or hiding
  • Temporary feature restriction
  • Repeat Violations or Moderate Violations:

  • Temporary account suspension (1-30 days)
  • Loss of specific features or privileges
  • Required acknowledgment of policies before reinstatement
  • Severe Violations:

  • Permanent account termination
  • IP or device ban
  • Reporting to law enforcement (for illegal activity)
  • Legal action where appropriate
  • Immediate Termination: Some violations result in immediate permanent termination without warning, including:

  • Child sexual abuse material
  • Terrorism or violent extremism
  • Human trafficking
  • Severe harassment or threats
  • Illegal activity posing imminent danger
  • 9.5 Appeals Process

    If you believe enforcement action was taken in error, you may appeal:

    How to Appeal:

    1. Email appeals@simulence.com within 30 days of enforcement action

    2. Include:

  • Your account email
  • Description of the enforcement action
  • Explanation of why you believe it was incorrect
  • Any relevant evidence or context
  • Appeal Review:

  • We will review appeals within 15 business days
  • We will provide a written response with our decision
  • Appeal decisions are final
  • Note: Frivolous, abusive, or repeated appeals may result in loss of appeal privileges.

    9.6 Immediate Suspension for Safety

    We may immediately suspend accounts without warning when:

  • There is imminent risk of harm to individuals or the public
  • Illegal activity is detected
  • Systems security is at risk
  • Required by law enforcement or court order
  • 9.7 Banned Users

    If your account is permanently terminated:

  • You may not create new accounts
  • You may not access the Services through other accounts
  • Attempting to evade a ban may result in additional enforcement
  • We may share ban information across our systems

  • 10. ACCOUNT TERMINATION GROUNDS

    Your account may be suspended or terminated if:

    1. You violate these Usage Policies or our Terms of Service

    2. You engage in illegal activity

    3. You pose a safety risk to others or the platform

    4. You repeatedly violate policies despite warnings

    5. You attempt to circumvent enforcement actions or restrictions

    6. You provide false information during registration or verification

    7. You engage in payment fraud or chargebacks abuse

    8. Your account is inactive for over one year (free accounts)

    9. We are required to terminate by law or court order

    10. Your use causes technical harm to the Services

    11. PLATFORM INTEGRITY

    11.1 Prohibited Manipulation

    You may not:

  • Manipulate platform features to gain unfair advantage
  • Exploit bugs or vulnerabilities for personal benefit
  • Coordinate inauthentic behavior
  • Create fake engagement or artificial virality
  • Game recommendation algorithms
  • Abuse referral or rewards programs
  • 11.2 Multiple Accounts

    Multiple accounts are permitted only if:

  • Each account is used in good faith
  • You do not use multiple accounts to evade restrictions
  • You do not use multiple accounts to manipulate systems
  • All accounts comply with our policies
  • 11.3 Truthful Representation

    You must:

  • Provide accurate account information
  • Not misrepresent your identity, affiliation, or credentials
  • Update your information when it changes
  • Not create misleading profiles or impersonate others

  • 12. UPDATES TO USAGE POLICIES

    12.1 Policy Changes

    We may update these Usage Policies from time to time to:

  • Reflect changes in law or regulation
  • Address new types of abuse or violations
  • Improve clarity and comprehensiveness
  • Adapt to evolving technology and user behavior
  • 12.2 Notice of Changes

    We will provide at least 30 days' notice of material changes through:

  • Email notification
  • In-app notification
  • Prominent notice on our website
  • Your continued use after changes take effect constitutes acceptance.

    12.3 Staying Informed

    We encourage you to:

  • Review these policies periodically
  • Check for updates when notified
  • Contact us with questions or concerns
